A System of Sentencing for Murder
A system of sentencing murder will require all offenders that have been convicted of murder to have a minimum term set. That is the minimum time that the one who has been convicted of an offense will have to serve before being eligible for parole. Additionally, in cases where a whole life order is in consideration, the case will be considered for the Appeals and Review Unit before other submissions have been made and a verdict passed by the court.
This sentencing system will depend on hard and fast guidelines. For example, when making a ruling, a court will consider the seriousness of the offense and any time that has been served while one is still in custody or remand. When considering how serious the crime is, the judge must have regard to the overall principles. The court will first provide a starting point based on examples that have been presented in Schedule 21, then consider any mitigating factor and the effects of a previous conviction of the defendants, whether the offense was committed on bail or there is any plea of guilty. The court will then state openly and in an ordinary language, the methods that it has used to make its conviction.
