Union decertification is a process by which the National Labor Relations Board (NLRB) permits workers to get rid of their union representation by calling for a special election (Thornton, 2015). In this development, an employer or company cannot play any role in the decertification process. In this process, the goal is to terminate the union’s right to represent the employee.
The process of Decertification
Step 1: File for decertification on time. For instance, under many unions’ agreements, decertification is not allowed in the first three years of representation, but is open in the last 90 days of the contract. During this time, there is a 30 day window period, after that when 60 days remain, it is not allowed.
Step 2: The workers draft the decertification petition, which they sign. At least 30 % of the employees must sign the petition for the NLRB to have an election via the secret ballot.
Step 3: The management should not take part in the process. The workers can perform the decertification process away from the work area and during their free time.
Step 4: If half of the employees vote for decertification, they will be union free and, therefore, will deal with their employers directly (Abraham et al., 2015).
